MF NIGHTS (referred to in this Policy as "we, "us" and "our”) are committed to protecting the privacy of our users and customers. This privacy policy ("Privacy Policy") is intended to inform you on how we gather, define, and utilise your Information (as defined below).

• It applies to Information collected by us or provided by you over our Website (including the mobile optimised version of the website accessible from your portable hand-held device) or in any other way (such as over the telephone, email, or WhatsApp). It is also intended to assist you in making informed decisions when using our Website and our services.

• All your personal Information shall be held and used in accordance with the EU General Data Protection Regulation 2016/679 ("GDPR") and national laws implementing GDPR and any legislation that replaces it in whole or in part and any other legislation relating to the protection of personal data. 1. What information we collect via our Website

a) When you visit our Website (including the mobile optimised version of the website accessible from your portable hand-held device) you may provide us with your full name, WhatsApp number, Instagram username, email, and birthdate. You may provide us with Information in the following ways:

• Voluntarily submitting your full name and Whatsapp number, and optionally your Instagram username, birthdate, and/or email, in the “Get Invited” section of the site and clicking ‘I’m interested’;

• by voluntarily corresponding with us by email, in which case we may retain the content of your email messages together with your email address and our responses; and/or

​​

• by voluntarily corresponding with us via WhatsApp, in which case we may retain the contents of your messages on WhatsApp, together with your WhatsApp number and our responses.

Any information other than full name, WhatsApp number, and Instagram username will be requested from you when necessary to provide a service (for example: email address).

b) We use the “Custom Audience pixel” of Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”) on our website. With its help, we can keep track of what users do after they see or click on a Facebook advertisement. This enables us to monitor the effectiveness of Facebook ads for purposes of statistics and market research. 

Data collected in this way is anonymous to us, which means we cannot see the personal data of individual users. 

However, this data is saved and processed by Facebook. Facebook can connect this data with your Facebook account and use it for its own advertising purposes, in accordance with Facebook’s Data Policy which can be found at https://www.facebook.com/about/privacy/. 
You can allow Facebook and its partners to place ads on and outside of Facebook. A cookie can also be saved on your device for these purposes.

2. How we store that information

Our website is hosted on the Wix.com platform. Your data may be stored through Wix.com’s data storage, databases, and the general Wix.com applications. They store your data on secure servers behind a firewall. More information here: https://www.wix.com/about/privacy

We communicate with you via WhatsApp. Your submitted WhatsApp phone number is inserted in the WhatsApp link (https://api.whatsapp.com/send?phone= number inserted here) to start a WhatsApp conversation with you without us having to store your data anywhere outside of Wix.com’s data storage platform. The contents of the conversation are not stored anywhere other than on WhatsApp, which uses end-to-end encrypted conversations.

3. How we use your information

We use your information to:

​

• keep you up-to-date about important changes to MF NIGHTS;

​​

• direct-market our events, services, promotions, invitations, and other information via WhatsApp. Before we do so, you will be given an option to opt-in to such communications and have the option to stop receiving direct marketing from us and/or have your data erased permanently from all out storage methods (i.e. wix.com platform and WhatsApp), at any moment;

​​

• answer your queries and respond to your requests;

​​

• book in reservations, add you to the guestlists, confirm invitations, book tickets, book bottle service, and any other type of booking with a third party. We will seek your consent to share information with a third party to provide a service/booking; and/or

​​

• release Information to regulatory or law enforcement agencies, if we are required or permitted to do so.

Your information may need to be used for similar purposes to those listed above, but never in way materially different. We do not share your information without your consent unless to a regulatory or law enforcement agency, if we are required or permitted to do so.

4. The legal basis for processing your information

Under GDPR, the main grounds that we rely upon in order to process your Information are the following:

• Necessary for the purposes of legitimate interests - either we, or a third party, will need to process your Information for the purposes of our (or a third party's) legitimate interests, provided we have established that those interests are not overridden by your rights and freedoms, including your right to have your Information protected. Our legitimate interests include responding to requests and enquiries from you or a third party, optimising our website and customer experience, informing you about our products and services and ensuring that our operations are conducted in an appropriate and efficient manner;

Where information needs to be shared to a third party to complete a service you have requested, we are unable to control the manner in which the third party handles your information.

We will only retain your Information for as long as is necessary for the purpose or purposes for which we have received it. The criteria that we use to determine retention periods will be determined by the nature of the data and the purposes for which it is kept.

For example, if we receive your information through our “Get Invited” form on our website, we will maintain this on WhatsApp and our Wix.com data storage indefinitely, until you request to have your information permanently removed.

7. Your rights relating to your Information

​

You have certain rights in relation to personal information we hold about you. Details of these rights and how to exercise them are set out below. We may require evidence of your identity before we are able to act on your request.

1. Right of Access. You have the right at any time to ask us for a copy of the Information about you that we hold, and to confirm the nature of the Information and how it is used. Where we have good reason, and if the GDPR permits, we can refuse your request for a copy of your Information, or certain elements of the request. If we refuse your request or any element of it, we will provide you with our reasons for doing so.
    

2. Right of Correction or Completion. If Information we hold about you is not accurate, or is out of date or incomplete, and requires amendment or correction you have a right to have the data rectified, updated or completed. You can let us know by contacting us at the WhatsApp number or email addresses set out above.
    

3. Right of Erasure. In certain circumstances, you have the right to request that Information we hold about you is erased e.g. if the Information is no longer necessary for the purposes for which it was collected or processed, or our processing of the Information is based on your consent and there are no other legal grounds on which we may process the Information.
    

4. Right to Object to or Restrict Processing. In certain circumstances, you have the right to object to our processing of your Information by contacting us at the WhatsApp number or email address set out above. For example, if we are processing your Information on the basis of our legitimate interests and there are no compelling legitimate grounds for our processing which override your rights and interests. You also have the right to object to use of your Information for direct marketing purposes. You may also have the right to restrict our use of your Information, such as in circumstances where you have challenged the accuracy of the Information and during the period where we are verifying its accuracy.
    

5. Right of Data Portability. In certain instances, you have a right to receive any Information that we hold about you in a structured, commonly used and machine-readable format. You can ask us to transmit that Information to you or directly to a third party organisation.
    

6. Right to Withdraw Consent. You have the right to withdraw consent for the processing and/or control of your personal data, which shall not affect the lawfulness of processing based on consent before the withdrawal.  You can do this by letting us know via the WhatsApp number or email addresses set out above.

 
This right exists in respect of information that:

• you have provided to us previously; and

• is processed by us using automated means.
   

While we are happy for such requests to be made, we are not able to guarantee technical compatibility with a third party organisation's systems. We are also unable to comply with requests that relate to Information of others without their consent.

Most of the above rights are subject to limitations and exceptions. We will provide reasons if we are unable to comply with any request for the exercise of your rights.
